Shoshana Berman Violates Own Publication Ban

So, it appears that Shoshana Berman (aka the Scissors Lady, pictured below) is now threatening to sue Jason Cherniak & Co. for violating "a publication ban on a personal matter regarding [her] son." This personal matter, of course, involves Shoshana assaulting him with scissors and telling him she wishes she'd had him aborted, according to the Guelph Mercury.

Dear Libloggers,

A former member of Liblogs, Shoshana Berman, recently told me that there is "a publication ban on a personal matter regarding [her] son". I have not yet been provided with a copy of this order. Although I do not know whetherher claim is legitimate, I feel that it is only fair for me to warn of you this claim.

Ms. Berman has threatened to take legal action against Liblogs, me personally and any blogger who contravenes the court order by publishing information relating to her assault trial. I reject any suggestion that Liblogs has any legal liability in this matter at all, but I will protectthe good name of the corporation if necessary.

Ms. Berman has also contacted individual members with complaints. I do not know at this time whether her complaints have any legal legitimacy. You will have to use your own judgement - and hire a lawyer if you feel it necessary - if you receive such a notice. I do not believe that Liblogs hasany legal responsibilities in this regard. To be safe, though, I ask each member not to search for and post copies of any articles that are out there, including any articles already printed by the Guelph Examiner, since the Liblogs aggregator would automatically link to the post on Liblogs. I am really sorry to bother you with this, but I don't think it would beright for me to not inform the membership of this situation.

Now, as someone who knows a thing or two about publication bans, I'll just say this. They're meant to protect victims, who are often children. They're meant to protect witnesses. They're not meant to protect insane bloggers who assault their children with scissors.

I'll also say this. This publication ban (assuming it exists and is not just a product of Ms. Scissorhands' imaginations) applies to her as well. In other words, if Jason Cherniak & Co. aren't allowed to blog about the trial, neither is Shoshana. Which makes the following post pretty interesting. In it, she identifies her son in a picture, and says he's lying so he can live in his dad's "big rich house." She also implies his dad made up the story to get a child tax credit.

Now, PNorth, as an adult why don't you read that article you are referencing again. Now I haven't really made comments on this article; but I'm feeling generous and relaxed today and i've had such a nice conversation with ONtory why not.

I have been contacted by several thoughtful, intelligent adults who read it and found the contradictions laid out in it quite startling. Also, the fact that it was even published, given that matters concerning minors are not allowed to be used for profit or gain by newspapers in Canada caused these thoughtful adults quite a bit of concern.

So a) the crown and the judge made a big mistake. b) the newpaper is an illegitmate tabloid piece of crap that exploits children for money. c) there are many contradictions in the testimony, even laid out in the tabloid piece of crap.

Read it again. Read it carefully. Think about how many other factors could be involved with a 14 year old, who wants to live with his dad in the big rich house, whose dad wants to stop paying child support and wants a child tax credit.

After you have been thoughtful about this, for even a few moments, get back to me.

Obviously, Jason Cherniak isn't the one who should be worried about violating the publication ban.
